Consignment Agreement

This agreement confirms that _________________________ (hereinafter

the “consignor”) has consigned to SCGaynor (hereinafter the “consignee”)

merchandise for public sale:

The following provisions will constitute the agreement between the parties:

1. Lots described will be offered for sale on ebay by the consignee.

2. Consignor guarantees full and clear title to all consigned items.

3. Consignee will be responsible for grading, describing and posting all items consigned as consignee sees fit to secure the highest price for the consignor.

4. A commission rate of __20__% * will be charged to the consignor on all lots sold. This is the only charge the consignor will incur.

5. In the event a winning bidder does not honor payment obligations, it is understood that the consignee is to sell the material in question to the next legitimate underbidder, the standard practice for resolving such matters.

6. Proceeds from the sale will be mailed to the consignor within a reasonable period of time after the close of the auction, pending payment by the winning bidder and the resolution of any claims arising from concerns over authenticity and/or condition.
